THIS INDENTURE made the eleventh day of October One thousand

nine hundred and eleven BETWEEN THE HONOURABLE

DR. HO KAI C.M.G. of Victoria in the Colony of Hong Kong Member

of the Legislative Council HO KOM TONG of Victoria aforesaid

Gentleman the Chairman of the Committee of Management and

Treasurer respectively of the "Brewin Charity Fund" and

LAU CHU PAK of Victoria aforesaid Gentleman a Member of the

said Committee for and on behalf of the said Committee of the

first part and THE TUNG WA HOSPITAL (incorporated by Ordinance No.1 of 1870) of the second part WHEREAS the parties hereto

of the first part and some of the Leading Members of the Chinese

Community of Victoria aforesaid recently opened a relief fund

called "Brewin Charity Fund" for the benefit of the Chinese

widows orphans and such other persons as are hereinafter

mentioned resident in this Colony and they have collected from

themselves and others for the purposes of such Fund divers

sums amounting in the aggregate to $39,862.98 AND WHEREAS at a

meeting of the subscribers to the said Fund duly convened and

held at the Tung Wa Hospital premises on the Thirtieth day of

September One thousand nine hundred and eleven the Gentlemen

hereinafter named were nominated Members of the Committee of

Management of the said Fund at such meeting it was resolved

that the said Fund should be named "the Brewin Charity Fund"

and be held by the said Tung Wa Hospital and be applied only

for the purposes for which it was so collected but not further

or otherwise in such manner as the Committee should in their

absolute discretion determine AND WHEREAS since the date of

such meeting the Committee have out of the moneys so collected as aforesaid invested the sum of $36,500:00 on Mortgages of

various leasehold properties in this Colony set out in the Schedule hereunder written and have paid the sum of $384.75
